EDITOR — Your story “Africa should support Uganda’s stance on homosexuality” refers. Applauding the further criminalisation of homosexuality is a futile and absurd concept. Despite the insistence by religions that it is unnatural or a dysfunction of some sort, the scientific facts on the subject tell an altogether different tale. The liberalisation of homosexuality in the Western world is not new, and it has not been sudden. In dozens of countries it has been unfolding with decades of scientific, legal and political exploration.
Thousands of challenges to anti-gay legislation in the courts, high courts, supreme courts, constitutional courts, courts of first instance, council chambers, parliaments, congresses, senates and Houses of Representatives of dozens of countries have consistently failed to generate valid arguments that sufficiently justify legislated denial or restriction of rights for homosexuals.
The consistent finding is that there is no argument based on fact, logic and reason that justifies legislating against it. Universities across the developed world have been exploring the subject for centuries, with the troubling result that the best they can come up with as argument against homosexuality is an assumption of dysfunction. Assumptions do not equate to facts. Assumption does not generate justification for anything.
The only remaining justifications are personal dislike and religious doctrine. Neither are they sufficient or valid justification for legislation in civil law, unless the civil society in question is a theocracy which implements scriptural doctrine as law. No society with a functioning separation of Church and state can indefinitely sustain anti-homosexual legislation. Any society that sustains anti-homosexual legislation renders itself a theocracy and negates any constitutional separation of Church and State.
Without fact, logic, reason and science backing the anti-homosexual legislation, any constitutional guarantee of equality under the law is rendered a deceitful lie. Equality is devolved to a concept only applicable to those selected to be worthy of equality, with the selection criteria decided not by reason or higher conscious intellect, but rather by the delusional ramblings of historic regimes and/or the personal tastes, faith and animus of those defining the selection. It renders the guarantee of equality a lie.
Anti-homosexual legislation renders the constitution a deceitful document presenting falsehood. A civilisation is defined in and by its constitution. When the defining document is based on falsehood, what does that make of civilisation?
